This document is a formal agreement between you (the "User") and Yandaz Nigeria Limited, a company duly incorporated under the Companies and Allied Matters Act (CAMA) 2020. Accessing our services implies an unconditional acceptance of these terms, governed by the laws of the Federal Republic of Nigeria.
Yandaz acts strictly as an online intermediary (classifieds platform). We are NOT an auction house, a retail store, or a payment processor. In line with the Cybercrimes (Prohibition, Prevention, etc.) Act 2015, we do not guarantee the authenticity of user-generated content. Users are solely responsible for conducting due diligence before any physical or financial exchange.
1.1. Legal Competence: You must be at least 18 years old. By registering, you warrant that you have the legal capacity to enter into binding contracts under Nigerian Law. Business entities must be registered with the Corporate Affairs Commission (CAC) to use "Business Store" features.
1.2. National Identity (KYC): To mitigate fraudulent activity (specifically "Yahoo-Yahoo" operations), Yandaz may require valid Nigerian Identification (NIN, Voter's Card, or International Passport) for specific listing categories including Real Estate, Vehicles, and High-Value Electronics.
1.3. Account Security: You are responsible for maintaining the confidentiality of your login credentials. Under the Nigerian Evidence Act, any action taken through your account will be deemed your electronic signature and legally attributed to you.
2.1. Intellectual Property: Users must not post images or text that infringe upon the trademarks or copyrights of brands. Listing "Replica" or "Grade 1" designer goods (Gucci, LV, Nike, etc.) is a violation of the Merchandise Marks Act and will result in immediate deletion.
2.2. Real Estate Listings: All property listings must comply with local state regulations (e.g., LASRERA in Lagos State). Agents must provide their registration numbers where applicable. Ghost listings (posting properties not available for sale/rent) are strictly prohibited.
2.3. Vehicle Listings: Sellers must disclose the true state of the vehicle (Nigerian Used vs. Foreign Used/Tokunbo). Providing a false VIN or misleading mileage is considered criminal fraud under the Nigerian Criminal Code.
3.1. Inspection Before Payment: Yandaz explicitly warns all users: Do not pay any "Commitment Fee," "Delivery Fee," or "Inspection Fee" before meeting the seller and seeing the item. Transactions involving bank transfers to unverified individuals are done at the user's extreme risk.
3.2. Limitation of Liability: To the maximum extent permitted by Nigerian Law, Yandaz Nigeria Limited, its directors, and employees shall not be liable for any direct, indirect, or consequential damages resulting from scams, physical assault during meetups, or defective products purchased via the platform.
The following items are banned from Yandaz Nigeria. Posting these may lead to your account being flagged for investigation by the EFCC, NDLEA, or NPF.
4.1. Premium Services: Yandaz offers optional paid visibility tools (Top Ads, Premium Stickers). These are digital advertising services. Once an ad goes live, the fee is earned and non-refundable.
4.2. Ad Deletion: If a paid ad is deleted because it violates our Prohibited Items list or is flagged by the Nigeria Police Force, no refund or credit will be issued.
5.1. Indemnification: You agree to indemnify Yandaz against any legal costs or damages arising from your listings or interactions with other users.
5.2. Governing Law: These terms are governed by the Laws of the Federal Republic of Nigeria. Any disputes shall be resolved through the Lagos Multi-Door Courthouse (LMDC) or the Federal High Court sitting in Lagos.
